3M Earplug Lawsuit Update 2021- Jury Awards $1.7M
A federal jury in Florida in April 2021 ordered 3M to pay $7.1 million in damages to three veterans who had been injured hearing damage from faulty earplugs made by the company.
On June 18, 2021, the Florida jury's verdict of $1.7 million in favor of the plaintiffs marked the second defeat for 3M in the Bellwether trial, which alleged hearing loss as a result of the 3M earplug.
The lawsuit was identified as a $300,000 lawsuit in the federal court against 3M for failing to negotiate with military members in hearing loss settlement. The company now faces massive liability for veterans who used 3M earplugs between 2003 and 2015 as standard equipment.
The second defeat in a trial over hearing loss allegedly caused by the company's earplugs is good news for 240,000 current and former US service members who suffered hearing loss and Tinnitus by the 3M earplugs whose lawsuits are still pending.
There are more than 230,000 product liability lawsuits in federal court filed against claims that the 3M Combat Arms Earplugs Version 2 (CAEV2) are defective, leaving US service members struggling with Tinnitus, hearing loss, and other problems related to the ear.
3m Earplug problems:
On behalf of veterans, hundreds of cases have been filed in connection with claims for hearing loss caused by faulty battle earplugs. Firms have filed a lawsuit for defective dual-end earplugs manufactured by 3M and Aearo Technologies, including a multi-county lawsuit currently in the Central District of Florida.
The 3M earplugs have not only caused hearing loss but are also responsible for painful Tinnitus. Thousands of US soldiers and veterans have sued government contractor 3M for oversupplying faulty earplugs during military tours to countries such as Iraq and Afghanistan between 2003 and 2015.

● 3M False Claims Act Lawsuit(2016-2018)
A whistleblower in 2016 filed a case on 3M earplug company under violation of the False Claims Act for selling the defective product to an agency, knowing the device design defect.
The whistleblower lawsuit alleges that both 3M and AEARO Technologies, Inc. misled the government with packaging and marketing, and about the safety of the CAEV2 earplugs.
After two years, in July 2018, the US Department of Justice announced that 3M Company had paid $9.1 million for settling a suit under the Whistleblower False Claims Act alleging that 3M sold defective Dual-End Earplugs (CAEV2) to the military.
